Course Description:
This is a course in advanced and applied constitutional law. It focuses on lawsuits against public officials and governments—ranging from police officers and local school boards to statewide officials and the president. The bulk of the course looks at constitutional and statutory claims brought under 42 U.S.C. § 1983. We shall consider topics such as what it means to act “under color of state law,” absolute and qualified immunities, government liability for the acts of individual officials, monetary and injunctive relief, and attorney’s fees awards. This course is particularly useful for students who plan to clerk on federal courts, because a substantial part of their docket involves § 1983 litigation.
NOTE:
Laptops are not allowed during class sessions.
