Course Description:
The course covers intestate succession (when a decedent dies without a will); the execution, revocation, republication and revival of wills and codicils; probate procedure and grounds for will contests, including the determination of a spouse's elective share; requisites for the creation and termination of private trusts and a close examination of their use in estate planning with an emphasis on future interests; the creation, use and termination of general and special powers of appointment; inter vivos transactions that serve as will substitutes and that affect testamentary disposition, including contracts to make wills; and the effect of change on dispositive descriptions and limitations in will including problems pertaining to common law lapse and the use of anti-lapse statutes. No tax aspects are considered and no knowledge of income or estate and gift tax is required.
NOTE:
Laptops are not allowed during class sessions.
