Course Description:
This course surveys federal and state law regulating consumer lending and other consumer transactions. We will discuss the law as it now exists and as it is likely to evolve under the new Consumer Financial Protection Bureau. Students will gain expertise with techniques of statutory and regulatory interpretation, familiarity with a number of substantive issues in consumer law, and exposure to perspectives from economics and other disciplines that have proven to be useful in understanding and critiquing this area of the law. Topics will likely include: consumer warranties and related topics; false advertising and other “false, unfair or deceptive” practices prohibited by the FTC act and state consumer protection statutes; mandatory information disclosure under statutes such as the federal Truth in Lending Act; the collection and use of consumer information including credit reports; and, various other topics in consumer finance, including predatory lending, abusive collection practices and the Fair Debt Collection Practices Act.
NOTE:
Laptops are not allowed during class sessions.
COURSE REQUIREMENT: Examination (80%) and class participation (20%)
