Course Description:

This course will study in detail the different mechanisms available for settling international disputes relating to the regulation of international trade and investment. The course aims to provide its students with a solid working knowledge of trade dispute settlement rules and practices in the World Trade Organization (WTO) and in regional trade agreements such as the North American Free Trade Agreement, as well as investor-state arbitration under bilateral investment protection treaties – the most frequently used international tribunals today. Moreover, the course will critique and analyze the powerful role played by these procedures in the development of international law and domestic policies. Issues that will be studied in this context include jurisdiction, applicable law, burden of proof, interpretation, appeals, compliance and enforcement.
