Course Description:
This course is about the relationship of the federal courts to state courts and the federal political branches; the course thus involves issues of federalism and separation of powers. Topics include the constitutional and statutory scope of federal question jurisdiction, congressional power to restrict federal court jurisdiction, the extent of Supreme Court review of state court judgments, sovereign immunity, the federal courts’ review of state criminal convictions by habeas corpus, and various statutory and judge-made barriers to the exercise of federal jurisdiction.
