Course Description:

This course will explore the web of interacting federal, state, and local laws that govern the police and police departments. While the police are often thought to be regulated by primarily by constitutional criminal procedure doctrines, in fact, many sources of law outside the Fourth, Fifth, and Sixth Amendments restrict police conduct and remedy or punish violations of conduct rules. Still other laws govern the hiring, training, and management of police officers and public access to information about the police. This course will consider the police as a regulated entity, looking at some of these doctrines, statutes, and administrative regulations. After an introduction to contemporary American policing, topics will include [1] rules governing the police conduct, including non-criminal-procedure rules, such as those arising out of First Amendment doctrine, the law of entrapment, and international law; [2] remedies for police misconduct, including the exclusionary rule, § 1983, criminal prosecution, and internal administrative discipline; and [3] the law governing the production and distribution of information about policing, such as state wiretap laws that regulate citizen videotaping of police officers. The format of this course is primarily lecture with some class discussion.

NOTE: Laptops are not allowed during class sessions.
