Course Description

This course will explore historical and modern controversies in administrative law and the separation of powers. Topics will include: the appropriate contours of executive, legislative, and judicial control over federal administration; the scope of judicial review of agency action; and the meaning of major statutes governing the administrative state, such as the Administrative Procedure Act. Our goal will be to conduct “deep dives” into a handful of the Supreme Court’s most recent administrative law cases, focusing on the historical sources and materials that the cases cite. The readings will include the Supreme Court opinions, recent and classic academic scholarship, and original sources that illuminate the cases.
