Constitutional Law of Cyberspace Operations (SC)

This short course explores the constitutional dimensions of U.S. cyberspace operations. After an overview of the technological and policy landscape, the course will consider the constitutional basis for authority to conduct cyberspace operations and structural government controls (such as congressional oversight) on them. The course will then move on to address various U.S. constitutional limitations on cyberspace operations, including the extraterritorial application of constitutional protections and the potential for application of First and Fourth Amendment limits. Because this is a rapidly developing field, the class will also consider current topics, such as digital assets, the security of digital information, and the potential for non-governmental actors to conduct their own activities in cyberspace.
