Course Description

This seminar will consider both “classic” and recent theories of contract law, including philosophical and economic theories. Among the questions we will consider are: What does it mean to have a “theory” of contract law? Are theories of contract law necessary? Useful? What are the key similarities and differences among the various theories?

Written Work Product

Students will submit several short response papers (2-4 pages) plus one longer final paper (10 pages), or students may opt to do a substantial research paper to satisfy the writing requirement due via EXPO by noon on December 18, 2024.. Students opting to submit a substantial research paper for their Upper-Level Writing Requirement must submit a "special request" form to SRO by October 1, 2024.
