Course Description

This elective will explore the concept of a growth culture, encompassing the science of failing well, and how that mindset can help Judge Advocates to be more effective in the practice of law. Decades of research on mindsets has shown that a person with a “fixed mindset” will often shy away from challenges, interpret mistakes or setbacks as reflecting a lack of ability, and give up more easily in the face of difficulty. Conversely, those with a “growth mindset” tend to believe that abilities can be developed over time through hard work, effective strategies, and support from others. This elective explores how individuals and teams can develop the mindsets necessary for successful legal practice. The elective will cover how cultivating a culture of growth enables team members to effectively manage risk and respond to failure in a healthy way. This elective will also explore the nuances and different types of failure to equip students with an effective framework for individual and collective resilience in the context of administrative and civil law, national security law, contract and fiscal law, and criminal law.

Grades are based on class discussion and participation and a final project. The final project will require students to write and present a solution to an mindsets for successful legal practice scenario.

Course Notes: The instructors for this course are LTC ROJAS and MAJ WALTERS. This course meets at the JAG School during its 3rd Quarter, January 7 - March 6, 2025. Due to weather, holidays, military requirements, etc., individual class sessions at the JAG School are subject to rescheduling on occasion. The JAG School attempts to reschedule make-ups at the same day/time slot, but there may be times when a meeting session date/time will not occur in the same day/time slot. All absences must be approved by the instructor. ENROLLMENT: Students seeking to enroll in this course must complete and timely submit a request e-form to SRO (available on LawWeb). The JAG School and Law School intend to finalize the roster of approved UVA Law students for this course by December 1, 2024.
