Course Description

In this seminar, students are prepared for work in the trial court and for the atmosphere of the courtroom. Extensive use is made of simulated trial episodes. During the early weeks of the semester, several phases of trial practice will be discussed, and students will be given the opportunity to perform the functions of trial lawyers on their feet using the simulated scenarios. These scenarios will include both civil and criminal matters and may include an allegation of sexual assault. These functions include opening statements and closing arguments, direct and cross examination, including handling of exhibits and objections. Students will be given the opportunity to act as witnesses during the exercises. Instruction in the practice and technique of advocacy is provided during each class session. Each student will participate in a full mock trial in the latter weeks of the term and will serve as individual or co-counsel for one of the litigants in the trial. Drafting required is limited to preparation of jury instructions for the final trial.

Written Work Product

Students will perform the functions of trial lawyers (opening statements and closing arguments, direct and cross examination, including handling of exhibits and objections), including preparation of jury instructions for the final trial. Students will also act as witnesses during the exercises. Each student will participate in a full mock trial in the latter weeks of the term and will serve as individual or co-counsel for one of the litigants in the trial. This course meets once per week for 120 minutes, not 180 minutes like other offerings of LAW 9081, based on a higher amount of out-of-class preparatory work expected from students.
