Course Description

This will be a relatively high-level survey of a range of individual rights topics, including post-New Deal substantive due process (e.g., parental rights, privacy, abortion, marriage, right to die, etc.), the Second Amendment, and the Speech, Press, Free Exercise, and Establishment Clauses of the First Amendment. To keep this manageable in a 3 credit hour format and minimize overlap with other courses, we will touch only lightly on issues of economic liberty (Lochner, and the Takings and Contracts Clauses), and exclude equal protection/civil rights issues and everything related to the criminal process. The allocation of time to subjects will be somewhat uneven, reflecting the interests of the instructor and the casebook editors and some bias in favor of issues that are timely and contentious.
