Course Description

This course will focus on state and federal laws governing allocation, management, and use of water and water resources. It will also examine policy and legal options for solving the primary water management challenges facing the United States, including water scarcity, groundwater depletion, protecting water quality, the impacts of land use on water resources, and restoring aquatic ecosystems. Topics will include state water rights regimes; legal, policy, and market-based tools for reallocating water among competing uses; federal regulation of water use through the Endangered Species Act, the Clean Water Act, and other statutes; regulatory takings for water rights; public rights to water and water bodies; and the resolution of interstate water disputes.
