Course Description

This seminar will survey the Supreme Court’s Sixth, Eighth, and Fourteenth Amendment decisions regarding the imposition and administration of the death penalty in the United States. The course will address issues regarding proportionality, individualized sentencing, ineffective assistance of counsel, prosecutorial misconduct, competency to be executed, categorical exemptions, methods of execution and abolition. We will discuss both the procedural and substantive issues unique to capital trials, appeals and post-conviction proceedings.
