Course Description

Although businesses and governments often are subject to traditional tort liability for accidental injury, this course addresses other forms of tort liability faced by business enterprises and governmental entities (as well as individuals under certain circumstances). These include liability for defective products, defamation, invasion of privacy, intentionally-caused economic harm, and governmental liability for negligence and violation of civil rights. The emphasis throughout is on the bases for the imposition of liability and the constraints (including constitutional limits) on liability. Separate consideration also is given to categories of recoverable damages and to the nature and impact of liability insurance.
