Course Description

This course will explore sentencing law and procedure, with a particular focus on the discretionary aspects of sentencing. After a general consideration of the purposes of sentencing, we will examine how sentencing authority can be allocated among legislatures, judges and prosecutors. In this process, we will discuss determinate and indeterminate sentencing regimes, and study different approaches to structuring judicial discretion, as implemented in the federal system and across states, including sentencing guidelines, mandatory minimum sentences, and sentencing enhancements. We will also look at the practice of plea bargaining and discuss how sentencing regimes interact with plea bargaining dynamics. Last, we will examine the way sentencing is implemented in the courts, including empirical and behavioral findings on how judges exercise their discretion in cases.
