Course Description

This seminar will survey the Eighth Amendment’s prohibition against the imposition of cruel and unusual punishment as it relates to the implementation of the death penalty in the United States, beginning with the Supreme Court’s ban and reinstatement of the death penalty in the 1970s. The seminar will address the Supreme Court’s subsequent Eighth Amendment limitations on the imposition of capital punishment. We will discuss topics such as proportionality, individualized sentencing, competency to be executed, categorical exemptions (both current and potential), methods of execution, conditions of confinement, and the current legal landscape regarding the abolition of the death penalty based on Eighth Amendment grounds.
