Course Description

Negotiation is ubiquitous in everyday life. And, of course, it is also relevant in a million ways to the practice of law. This class will teach negotiation skills mostly through your participation in role-play simulations – some legal, some not. For each case, you will be assigned a role, and will receive background materials, instructions, and usually confidential information to help you (do some or all of): prepare to interview a client, write a memo, decide whether to negotiate, conduct a negotiation, and report the results. CLASS ATTENDANCE IS MANDATORY when there is a NEGOTIATION SIMULATION because your absence will strand other classmates who were assigned to negotiate with you. Most weeks will have one day with a simulation. **IMPORTANT: On 2 or 3 weeks, the Wednesday class will begin early – at 1:00pm – in order to allow enough time for a simulation. (This will be arranged not to interfere with Student Services programming aimed at a large number of students). Class days without simulations will contain other forms of active learning (e.g., demonstrations; you present negotiation strategies; analyze existing real-world negotiations; etc.). The course will: (1) introduce students to negotiation theory, with a focus on the "collaborative" negotiation method used by most successful negotiators today; and (2) teach relevant psychological principles that will help students reflect on their own negotiating skills and understand the likely behavior of others in negotiation settings.

Written Work Product

For most classes there will be a short (1-3 pages) reflection paper due on Canvas (e.g., reactions to readings; describing how you prepared for a negotiation; describing what happened during the previous exercise; considering implications of a psychological experiment; evaluating a real-world negotiation). ONE LONGER PAPER: Description/analysis of a real-life negotiation due via EXPO by noon on December 7, 2023. ONE FINAL PAPER: Analysis of a negotiation simulation (due via EXPO by noon on December 20, 2023 (the day before last day of exam period).

Other Work

Participating in short online or in-class experiments that illustrate various psychological points from the class. (Results typically anonymous but participation scored.)

Prerequisites: Because the credits in this course count toward the JD Program Professional Skills requirement, JD candidates will be given enrollment priority for this class. Concurrencies: None

Course Notes: Attendance at every class in which there is a negotiation simulation is mandatory. On 2 or 3 weeks, the Wednesday class will begin early – at 1:00pm – in order to allow enough time for a simulation. The instructor will notify SRO of the name of any enrolled student who does not attend the 1st class session so that such student may be dropped from the course. Students who are not enrolled but attend the first class session are eligible to fill empty seats (if any), prioritized by position on the waitlist. Grades depend on class participation, including participation in the negotiation exercises and debriefing sessions (but not on the outcome of the negotiation); participation and/or performance on other assignments throughout the semester; and on papers described in “Written Work Product” above.
