Course Description

What do these two scenarios have in common: choosing which movie to watch with a friend, and striking an appropriate plea deal for a client? The answer: they both require you to negotiate. As a lawyer, you will negotiate every day, and not just on behalf of clients in matters like business deals or criminal plea bargains. You will negotiate with colleagues as you hash out the details of your work assignments, with potential employers over salary and compensation issues, and with those outside of work in settings as routine as choosing who should do the dishes or as significant as buying a home. This class will arm you with the theory you need to know to succeed in a negotiation, give you many opportunities to practice your skills through a series of role-play simulations from a range of settings, improve your ability to understand and predict the behavior of others during a negotiation, and offer you a constructive environment in which to learn about yourself and your strengths in a variety of negotiation settings.

Written Work Product

Students will submit three 5-7 page papers during the course of the semester. A final 8-12 page paper will be due via EXPO by noon on May 9th (the day before the last day of the final exam period).

Prerequisites: Because the credits in this course count toward the JD Program Professional Skills requirement, JD candidates will be given enrollment priority for this class. Concurrencies: None

Course Notes: Attendance at every class is mandatory. Enrolled students who do not attend the first class session will be disenrolled in accordance with Academic Policy. Students will participate in negotiation simulations both in class and outside of class time. Students may not share "confidential" materials with others with whom they are negotiating.
