Course Description

As 1940 drew to a close, the United States declared itself the "Arsenal of Democracy"; as 1991 drew to a close, the Soviet Union dissolved itself. In the roughly fifty years in between, the United States played a crucial role in defeating or containing totalitarian dictatorships in Germany, Italy, Japan, China, and the Soviet Union. This seminar examines whether law played a significant role in the outcomes of World War II and the Cold War, in terms both of international law and US constitutional law. (We may also refer to current events.) No prior knowledge of the relevant history or law will be taken for granted.
