Course Description

This course will examine the Supreme Court from the perspective of its institutional role and the behavior of its members and of those whose professional lives circle around it. Since our aim is a better understanding of how constitutional law is made, the focus will be on the making, rather than on the substantive law.

Written Work Product

Please check the Syllabus frequently, as it is in part a narrative that offers context for some of the readings. It will evolve to reflect newly published articles and new developments at the Court. This is obviously a crucially busy period for the Court, and part of our job will be to keep up with developments. So do re-check the Syllabus regularly as assignments might change. For many classes, there are long lists of recommended readings (all of which, except for Paul Kahn "Making the Case" are posted on Canvas). These are not meant to induce alarm but are posted simply as a resource for anyone who is particularly interested in one of our topics, either now or for future projects. The Syllabus clearly differentiates between readings that are required and those that are simply there for your reading pleasure. At the close of class, several students will be asked to submit one- or two-page responses to the readings in advance of the following class, to kick off class discussion.

Other Work

This is a discussion rather than a lecture course. Everyone will take the self-scheduled final exam. Your grade will be based on class participation as well as on the exam. Please come to class prepared to make substantive contributions.
